Hello Tamila!

Indeed, cell phone location data was allowed to be obtained by police forces without a warrant. It is a Sixth Court the one to blame for that. They have stated that defendant had no reasonable expectations of privacy because his cell phone was voluntarily purchased and if police used tools available to them than it is ok.

Moreover, Sixth Court explained their decision quite simply - they compared it to the dogs which track the scent they have picked up while potential criminal is unaware of giving that scent off or of the dog that picked it up. So now the defendant regrets about purchasing the high-end smartphone with all those technologies inside.
